By creating an account or using ZenithMind, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.

2. Description of Service

ZenithMind provides guided meditation sessions, sleep stories, mindfulness exercises, and related wellness content through our iOS mobile application. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time.

3. User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

4. Subscription and Payment

ZenithMind offers subscription-based access to premium content:

• Subscriptions are billed through your Apple ID account
• Payment is charged at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage subscriptions in your Apple ID account settings
• No refunds are provided for unused portions of a subscription period

5. Free Trial

We may offer a free trial period for new subscribers. If you do not cancel before the trial ends, you will be automatically charged for a subscription. You may cancel at any time during the trial period without charge.

6. Acceptable Use

You agree not to:

• Share your account with others
• Copy, distribute, or modify any content from the app
• Use the service for any illegal purpose
• Attempt to reverse engineer or hack the application
• Upload malicious code or interfere with the service

7. Intellectual Property

All content, features, and functionality of ZenithMind, including but not limited to text, graphics, logos, audio clips, and software, are owned by ZenithMind and protected by copyright, trademark, and other intellectual property laws.

8. Health Disclaimer

ZenithMind is designed for wellness and relaxation purposes. It is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or qualified health provider with any questions regarding a medical condition.

8a. Nature of Service and Medical Disclaimer

The AI-powered chat feature within ZenithMind is designed strictly for wellness, relaxation, and meditation recommendation purposes. ZenithMind is not a medical device, and the AI does not provide clinical therapy, medical diagnoses, or crisis intervention. Users should consult a licensed healthcare professional for any mental or physical health concerns.

8b. Intellectual Property and Data Usage

By using the ZenithMind chat feature, the user grants ZenithMind a non-exclusive, royalty-free, perpetual, and irrevocable right to use anonymized and de-identified data derived from user interactions for the purposes of Research and Development (R&D). This includes, but is not limited to, the training of proprietary algorithms and the improvement of the application's recommendation engine. ZenithMind retains full ownership of any models or technological improvements developed using this de-identified data.

9. Limitation of Liability

To the maximum extent permitted by law, ZenithMind shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the service.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or in-app notification. Continued use of the service after changes constitutes acceptance of the modified terms.

11. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice, for any breach of these Terms of Service. Upon termination, your right to use the service will immediately cease.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
